Terms of Service

Welcome to OgenkoCat, a mobile application ("App") provided by System Neko ("we," "us," or "our"). By using our App, you ("User" or "you") agree to be bound by the following terms and conditions ("Terms of Service").

1. Acceptance of Terms
These Terms of Service govern all use of the App and its services. In addition to these Terms, we may establish additional rules and guidelines ("Supplementary Terms") related to specific services. These Supplementary Terms are considered part of these Terms of Service. In case of conflict, the Supplementary Terms will take precedence unless stated otherwise.

2. User Registration
Upon starting to use the App, you agree to complete the user registration process. This process involves managing your information on our servers. We reserve the right to deny registration if:

• False information is provided during registration

• The applicant has previously violated our Terms of Service

• We determine, at our discretion, that the registration is not appropriate
  
  

3. User ID and Password Management
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You may not share, transfer, or lend your credentials to anyone. We are not liable for any loss or damage arising from unauthorized use of your credentials, except in cases of our gross negligence or willful misconduct.

4. Prohibited Activities
When using the App, you agree not to engage in the following activities:

• Violating any applicable laws or regulations

• Conduct related to criminal activities

• Infringing on intellectual property rights of the App or others

• Disrupting servers or networks connected to the App

• Commercially exploiting any part of the App without our prior written consent

• Interfering with or disrupting the service or servers or networks connected to the service

• Attempting unauthorized access to the App or related systems and networks

• Collecting or storing personal data about other users without their consent

• Using the App for any fraudulent or inappropriate purpose

• Causing harm or disadvantage to other users or third parties

• Impersonating another user or any other person

• Advertising, soliciting, or transmitting any commercial advertisements, including chain letters, junk email, or repetitive messages to anyone

• Engaging in any activity that promotes or provides benefits to criminal or antisocial elements

• Any other activity deemed by us to be in conflict with the spirit or intent of the service
  
  

5. Suspension and Interruption of Service
We may suspend or interrupt the provision of the App without prior notice for reasons including, but not limited to:

• Maintenance or update of the computer system related to the App

• Inability to provide services due to force majeure events

• Interruption or malfunction of computers or communication lines

• Any other situation where we deem it difficult to provide the App

We shall not be liable for any disadvantage or damages incurred by you or any third party due to such suspension or interruption of service.

6. Restrictions and Termination of Use
We may restrict your access to the App or terminate your account without prior notice if you:

• Violate any provision of these Terms of Service

• Provide false information during registration

• Fail to respond to communications from us within a reasonable time frame

• Have not used the App for a specified period

• Are deemed by us to have engaged in inappropriate use of the App

We shall not be liable for any damages resulting from actions taken under this section.

7. Withdrawal
You may withdraw from the App and terminate your account at any time using the account management features within the App. Upon withdrawal, all data associated with your account will be deleted from our databases and cannot be recovered. The withdrawal process is final and cannot be reversed. After withdrawal, you may continue to use the App in a limited capacity as an unregistered user. If you wish to use our services again, you will need to register a new account.

8. Disclaimer of Warranties and Limitation of Liability
We exclude or limit our liability as follows for any situations that may arise in connection with the use of this app.

• We do not guarantee that the App is free from defects (including but not limited to stability, reliability, accuracy, integrity, effectiveness, fitness for a particular purpose, and security).

• We are not liable for any damages arising from the use of the App, except in cases of gross negligence or willful misconduct on our part.

• We are not responsible for the content of any advertisements displayed within the App or for any goods or services provided through such advertisements. Advertisers bear full responsibility for advertisement content, and we do not endorse or guarantee the accuracy or reliability of any advertisement information.

• Our liability for any damages caused by our negligence (excluding gross negligence) or breach of contract is limited to the amount of fees paid by you in the month in which the damage occurred.

• We are not responsible for any transactions, communications, or disputes between you and other users or third parties arising from the use of the App.
  
  

9. Changes to Service or Terms
We reserve the right to modify or discontinue the App, or to change these Terms of Service at any time. By continuing to use the App after such changes, you agree to be bound by the revised Terms.

10. Privacy Policy
We are committed to protecting your privacy. Our Privacy Policy, as may be updated from time to time, explains how we collect, use, and protect your personal information. By using the App, you agree to the terms of our Privacy Policy.

11. Copyright
You may not copy, reproduce, distribute, or create derivative works from any part of the App or its content without our express written permission. All rights not expressly granted to you in these Terms of Service are reserved by us.

12. Communication
All communications from us will be sent to the contact information you provide during registration. It is your responsibility to keep your contact information up to date.

13. Assignment
You may not assign or transfer your rights or obligations under these Terms of Service without our prior written consent.

14. Governing Law and Jurisdiction
These Terms of Service and the use of the App shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from or related to these Terms of Service or the App shall be subject to the exclusive jurisdiction of the courts of Japan. This includes any dispute relating to the existence, validity, or termination of these Terms of Service.
